In December 2024, a Texas Federal District Court has issued a nationwide preliminary injunction against the Corporate Transparency Act (CTA), ruling that the law may violate the 1st and 4th Amendments of the U.S. Constitution. This decision means small business owners are not required to comply with the CTA for now. The injunction is temporary, and the government is likely to appeal, possibly asking for an expedited review. Since the decision is not final, compliance with the law may be reinstated depending on the outcome of the appeal.
The injunction complicates matters for small businesses that were approaching the December 31, 2024 filing deadline. The case may eventually reach the Supreme Court, which means the situation could change in the coming weeks.
